Centre Releases Draft Rules for New Labour Codes

The Union government released draft rules on Wednesday that explain how the New Labour Codes laws will be put into effect on the ground. This came a month after they announced four new labor codes. The draft rules, which are open for public comment for 30 to 45 days, spell out important details about how to figure out the minimum wage, how many hours people can work, how to recognize trade unions, and how to provide social security for gig and platform workers.

One of the most important parts of the draft New Labour Codes is how to figure out what the minimum wage should be. The proposed framework says that minimum daily wages will be based on what a typical working-class family of four needs to live. This family would include the worker, their spouse, and two children. This method shows a change from only looking at wages based on the market to looking at living standards in a wider social and economic context.

The calculation has a number of parts that are meant to show what a real household needs. These include a daily caloric intake of 2,700 calories per person, an annual clothing requirement of 66 meters for the family, and housing costs that are 10% of the total food and clothing costs. Also, 20% of wages go toward basic needs like gas, electricity, and other household needs. Another 25% goes toward education, healthcare, recreation, and unexpected expenses.

People who know about the drafting process say that the wage framework is based on the ideas set out in the Reptakos Brett judgment. This was a landmark decision that said wages are a social right, not just a contract between an employer and an employee. The new rules are likely to lead to higher minimum wages once the labor codes are fully enforced because they take into account more living costs.

The draft rules also talk about working hours, in addition to pay. The maximum number of hours that people can work in a week is now 48. This makes things more consistent across all sectors. The government has said, though, that they will send out separate information about daily working hours, rest breaks, and spread-over time. Experts in labor say that this change makes India’s labor standards more like those of other countries, but it still allows for sector-specific needs.

Trade union recognition is another important topic that the draft New Labour Codescover. The rules set out how to check if someone is a member of a union and how to find out if they are a representative in a workplace. The goal is to cut down on arguments about the legitimacy of unions and make collective bargaining more organized. Clear rules for verification should make labor relations easier and make the process of recognizing unions more open.

Rules for New Labour Codes

The draft rules also set the stage for more people to be covered by social security, especially gig and platform workers, who have not been covered by formal labor protections in the past. The new plan calls for a National Social Security Board to recommend and oversee welfare programs for gig workers, platform workers, and unorganized workers. The draft outlines the board’s makeup, duties, and advisory role. This shows that support for new types of work is becoming more formalized.

People see the inclusion of gig and platform workers as one of the most forward-thinking parts of the New Labour Codes. Policymakers have realized that they need to extend social security benefits like health insurance, maternity leave, and old-age protection to this part of the workforce because app-based services and flexible work arrangements are growing so quickly.

During the consultation period, industry groups and trade unions are expected to closely look at the draft rules. Some employer groups have raised concerns about compliance costs and operational flexibility, while labor organizations have praised the focus on higher minimum wages and social security. Before the rules are set in stone, the government has said that it will take into account feedback from stakeholders.

Once they are in place, the new labor codes and rules are expected to change India’s labor laws in a big way. The government wants to make it easier to do business while also making sure that workers are taken care of by standardizing wages, working hours, and social security benefits. The rules will take their final shape after consultations in the next few weeks, but officials say that the changes are a big step toward bringing labor laws up to date with today’s economic and social realities.
